Pharmaceutical & Misfilled Prescription Cases
When you purchase a prescription or over-the-counter drug for yourself or your family, you hope that it will cure your ailment and you certainly expect it to be safe. However, as demonstrated by recent events, some pharmaceutical companies fail to adequately test their products before placing them on the market and some companies have been alleged to have withheld critical and damaging studies and information from the public and the Federal Drug Administration.
For example, on September 30, 2004, Merck issued a world-wide recall of its prescription drug Vioxx. The recall was issued because Vioxx has been associated with strokes, heart attacks, blood clots, cardiovascular injuries and other serious Vioxx side effects. In fact, it has been discovered that an internal study found that patients who took Vioxx for 18 months or longer were twice as likely to suffer a heart attack, stroke or other cardiovascular injury. This led the FDA to send Merck a Warning Letter that stated Merck was engaging in a false or misleading promotional activity that minimizes the potentially serious cardiovascular findings's from prior studies. Thus, the FDA concluded Merck's advertising misrepresents the safety profile for Vioxx.
While some prescription drugs like Vioxx have received news attention for their adverse and harmful side effects, there are also over-the-counter medications that have been shown to cause serious and permanent injuries. For example, Stephens & Anderson currently represents several clients who lost all sense of smell and taste as a result of using the nasal spray known as Zicam.
While most prescription drugs are safe when used and prescribed properly, serious damage can be done if and when a pharmacy misfills a prescription by providing the patient with either the wrong dose or the wrong drug. Stephens & Anderson has successfully handled several misfilled prescription cases throughout Texas.
